Supreme Court Reinstates Excessive Force Case Linked to Fatal Houston Police Shooting


The Supreme Court has permitted Janice Hughes, the mother of Ashtian Barnes—a Black man killed during a traffic stop—to pursue a civil rights lawsuit against the police officer involved in his shooting. On April 2016, Officer Roberto Felix Jr. shot Barnes twice after jumping on the door sill when Barnes’ car began to move forward as he was speaking with Felix. The Court criticized a lower court’s narrow focus on the moment of force use, asserting that all preceding circumstances must be evaluated to determine the reasonableness of police actions. Justice Elena Kagan, writing for a unanimous Court, emphasized the importance of considering the “totality of the circumstances,” thereby rejecting the so-called “moment of the threat doctrine,” which had limited the scope of legal assessments in similar cases.

This ruling allows Hughes to advance her excessive force claim under the Fourth Amendment. Nevertheless, she still faces challenges, particularly as Officer Felix may invoke qualified immunity—a legal shield for officers whose actions were not clearly deemed unlawful at the time. Hughes has expressed her commitment to the case, wanting to ensure her son is recognized as a victim within a broader context of police violence against Black individuals.

Previously, lower courts had denied Hughes’ claims, but both a district court and a judge from the 5th U.S. Circuit Court of Appeals criticized the restrictive doctrine that overlooked events leading to force usage. Although the Supreme Court’s decision is a victory for Hughes, the case presents ongoing legal hurdles, especially in light of the qualified immunity doctrine. Hughes also filed a separate claim against the police department, which remains separate from the current Supreme Court proceedings.
